Introduction

With the passing of the Police, Crime, Sentencing & Courts Act 2022, Parliament has added to the already rather lengthy list of factors which aggravate assaults.

Some offences give the courts power to increase sentence from that of the basic offence; others require courts to increase sentence within the sentencing limits of that offence.

This webinar is designed to help practitioners at all levels with regards to sentencing in cases of assault, particularly when there is said to be an element of aggravation to the offence.

What You Will Learn

This webinar will cover the following:

  • The new aggravating factors under the Police, Crime, Sentencing & Courts Act 2022
  • Assault on an emergency service worker - has sentence been changed again and does the person have to be in the execution of their duty?
  • Racially or religiously aggravated ABH
  • Racially or religiously aggravated grievous bodily harm/unlawful wounding
  • What evidential proof does the court require in order to find an offence is ‘aggravated’ for the purposes of the Sentencing Code?
  • Sentencing in racially/religiously aggravated offences - what approach should the court take?

This webinar was recorded on 23rd January 2023
