Boundary disputes and adverse possession claims are often inextricably interlinked; they can blight commercial development and lead to bitter neighbour relations between residential landowners - as well as to the loss of land.

This 2-hour Learn Live session provides a useful review of the 'old' and 'current' legal systems for claiming title by adverse possession, the court's approach to resolving boundaries disputes and the impact of such findings on ownership claims as well as the practical lessons from recent case law.

What You Will Learn

This live and interactive session will cover the following:

  • How the Limitation Act 1980 can still blight development land: Mitchell v Watkinson
  • Factual possession - has the law changed? Thorpe v Frank; Rashid v Nasrullah; Dyer v Terry
  • The importance of topographical features, extrinsic evidence & presumptions: Stanning v Baldwin; Pennock v Hodgson; Ali v Lane; Parmar v Upton; Hawkes v Howe; Boas v Aventure
  • Adjacent land and continuity of possession: Smith v Frankland; Chambers v LB Havering

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
