Social care has been pushed to the front of public consciousness over the course of the pandemic so far.

This is against the backdrop of the Care Act 2014 having implemented changes to care and support five years ago, and the Mental Capacity Act 2005 being the subject of an imminent review in the form of the liberty protection safeguards.

This new virtual classroom seminar is aimed at those practising in the area of community care, where the Care Act and Mental Capacity Act and other welfare schemes intersect.

It will assess how the statutory schemes have performed generally, and particularly when stress-tested by the pandemic, and consider what developments are likely in the future in these areas.

What You Will Learn

This live and interactive session will cover the following:

  • Care and support - recent case law and legislation
  • The ‘easements’ under the Coronavirus Act and the application of the s1 Care Act well-being principles
  • The division between NHS and social care funding and how this been affected by the pandemic
  • Mental Capacity Act - how can the ‘least restrictive’ principle be reconciled with the high level of restriction to which those in care homes and in the community are subject?
  • Issues for the future - liberty protection safeguards, will they produce a different result for those deprived of their liberty?
  • Care and support and NHS funding - a need to review the division?
