Introduction

Self-defence is one of the commonest defences run in the criminal courts, however, it is important to get it right as there have been many developments in the last few years.

This virtual classroom seminar takes a thoroughly practical look at the law in this area, with real-life examples. It is aimed at both the prosecution and defence, and it is a must for advocates on both sides as well as those advising clients, for example, at the police station. CPS charging lawyers will also find this live session helpful.

This live session highlights the practical issues and key caselaw involved in proving or rebutting the defence. It is also ideal as a refresher to sharpen your skills and will be updated whenever there are new cases or other developments you need to know about.

What You Will Learn

This live and interactive course will cover the following:

  • S76 CIJA 2008 - every day self-defence
  • Householder cases
    • What is a ‘dwelling’ for these purposes?
    • People living together and the householder defence
    • The consequences of intoxication for a defendant
    • Repelling people lawfully entitled to be on the premises
    • Underlying mental health conditions and self-defence
  • Who must prove what? When?
  • Can the defence be made out? When can the judge remove the defence at trial?
  • Prosecutors - can you rebut the defence? How?
  • Defence - how do I prove the evidential basis of my defence?
  • Relevant Criminal Procedure Rules
  • Other potential ‘prevention of crime’ defences
  • Is self-defence really mitigation?
  • Basis of Plea and Newton hearings
