Introduction

In an ideal world, everyone would have a valid lasting or enduring power of attorney in place so that if they lost capacity to manage their finances themselves, their chosen attorney(s) would be able to act for them.

Unfortunately, though, many people do not have this safeguard in place.

If they lose capacity, an application to the Court of Protection will be necessary to appoint a deputy or deputies (either professional or lay - e.g., family members) with authority to access and manage their finances on their behalf.

This short webinar is designed to guide you through the online deputyship application process from the initial application through to receiving the deputyship order, providing practical advice and tips to assist legal professionals.

What You Will Learn

This webinar will cover the following:

  • What preparatory steps you should take including:
    • Checking for existing powers of attorney
    • Providing the appropriate evidence of lack of capacity
  • Preparing the application forms:
    • What forms to complete
    • What information and supporting documents you will need to complete them
  • Giving notice of the application ahead of submission:
    • Who you should notify
    • How should you notify them
    • What to do if there is no response?
  • Selling P’s property - additional authority that you will need to ask for and how to get it
  • Urgent matters - asking for an interim order
  • How to submit the online application including paying the fee
  • What you need to do when the order is made, including setting up a security bond

This pre-recorded webinar will be streamed at 12:30pm on Tuesday 16th July 2024 and will remain available to view by delegates who have registered by then for 90 days.
