Introduction

This course will cover all issues relevant to the law practice and procedure in the police station and at the Magistrates' Court, thereby satisfying the contractual requirement that Duty Solicitors attend a course relevant to advising clients at the police station stage and at the Magistrates' Court.

Advising clients who are suspects at the police station and are first-time listings in the Magistrates' Court is never easy. This may be their only brush with the criminal justice system and they will need much assistance and guidance as to what to do.

In order to discharge the exacting duty it is absolutely crucial that you are up-to-date with case-law and legislation in order to give the client the best possible advice as to the options available. If you decide to attend one course this year then this should be it.

What You Will Learn

This course will cover the following:

  • The Duty Solicitor at the Police Station:
    • Obtaining disclosure and the European Directive
    • Reduction in sentence for an early guilty plea - the effect upon sentence of having made full admissions in the interview and having been fully co-operative at the investigation stage
    • The Policing and Crime Act 2017 - clients attending as volunteers and being released pending further enquiries/investigations - the advice you need to give at the conclusion
    • A working knowledge of the Sexual Offences Act 2003 - consensual and non-consensual sexual activity
    • A working knowledge of the Sexual Offences Act 1956 - consensual and non-consensual sexual activity
    • Some difficult client scenarios
    • Dealing with the interview by means of a pre-prepared written statement
    • Part 9 of the 2017 Standard Crime Contract - Specification - operative 1st of April 2017
    • The new test for dishonesty following Ivey v Genting Casinos [2017]
    • Res gestae and body cam footage and hearsay generally in domestic cases
    • Breach of pre-charge bail conditions as a criminal offence carrying 12 months imprisonment
    • The lawfulness of an arrest in order to impose bail conditions and the case of R (TL) and the Chief Constable of Surrey police [2017]
  • The Duty Solicitor in the Magistrates' Court
    • Parts 6 and 10 of the 2017 Standard Crime Contract - Specification - operative 1st of April 2017
    • Advising on the issue of a reduction in sentence for a timely guilty plea - adults and youths - new guidance from the Sentencing Council with effect from 1st June 2017
    • Advising children and young people generally - new guidance from the Sentencing Council with effect from 1st June 2017
    • The new test for dishonesty - Gosh is no longer to be followed
    • A not guilty plea and case management - your approach to the preparation for effective trial form (PET) when the client has no defence and refuses to enter a guilty plea
    • Your approach when the client wishes you to represent them on a guilty plea even though your instructions amount to a denial of the offence
    • Advising clients as the Court Duty Solicitor in circumstances when they already have a solicitor in the proceedings
    • Advising generally in the area of alcohol and drugs - driving, attempting to drive and in charge - including those circumstances in which the client fails to provide
    • Things you need to know when acting as the Court Duty Solicitor in the Breaches Court
    • Your duties to the client and your duties to the Court
    • A reminder of the people for whom you must act and the people who are not covered by the Duty Solicitor Scheme
    • Case management and your duties under the Criminal Procedure Rules 2015 as amended
