Witness Statements in Civil Disputes - The Latest with Dominic Regan
Speaker
Introduction
Witness statements represent the core of litigation evidence. They stand as evidence in chief at trial, which means it is imperative to prepare them in compliance with the Rules.
If relevant material is omitted, then it is not in evidence and that could make the difference between winning and losing. To this day, some fail to appreciate that if a statement is not served in the time specified by the court, it is not admissible unless there is a successful Denton application for relief from the sanction imposed by CPR 32.10.
