Landowners, developers and promoters face increasing challenges when seeking the removal of utility apparatus to allow development to proceed. This course sets out the rights of utility companies in seeking to retain or divert utility apparatus and sets out where the financial liability for such work falls.

This course is aimed at lawyers and surveyors advising owners and promoters of development land, whether residential or commercial, and is designed to provide a comprehensive overview of the rights utility companies, with a focus on electricity, have and how these can be terminated or varied to enable development to proceed unhindered.

It will cover the various statutory powers enjoyed by utility companies, how to approach wayleave and easement negotiations and the ability of utility companies to use their statutory powers. The course will also cover the procedural requirements utility companies have to satisfy in seeking to retain infrastructure and the assessment of compensation due to landowners and occupiers.
