Introduction
The Data (Use and Access) Act 2025 introduced new provisions in the Data Protection Act 2018 creating a new right to complain for data subjects and corollary obligations on data controllers to implement mechanisms to handle complaints, with the Information Commissioner’s Office issuing new guidance on the complaints requirements and expectations for controllers.
Coupled with the ICO’s own new approach to handling complaints to them, controllers will be expected to resolve more disputes themselves and if they fail to do so, risk complainants taking matters into their own hands and pursuing legal proceedings, increasing costs.
