Competition litigation is evolving quickly, driven by: (i) major recent judgments, including Kent v Apple, Evans v Barclays Bank and others and the pass-on rulings in Interchange Fees and Granville; (ii) new CAT guidance on expert evidence; and (iii) increasing practical experience as the collective actions regime matures, particularly around funding, settlements and distribution. Further changes are expected, in light of the Department for Business and Trade’s review of the regime.
