Introduction

The 22 March 2026 will see the introduction of the first limb of the Sentencing Act 2026.

The key measures being introduced on the 22 March 2026 are:

  • Extension of the maximum period for sentence deferral
  • Presumption in favour of imposing a suspended sentence
  • An increase in the maximum duration of a suspect sentence
  • Amendments to the Bail Act that will impact on remand decisions

The Act will bring in a number of new provisions which will have a significant impact on how we, as prosecutors complete our daily work.
