Introduction

This course will provide an overview of the weapons available in a landlord's armoury when it comes to tenants who default on their lease obligations.

The default may be not paying the rent, failing to repair, sub-letting without the landlord's consent, or a variety of other breach of covenant situations.

What You Will Learn

This course will cover the following:

  • Monetary default - Simple debt claim, service of statutory demand, CRAR, regulation of service charges in mixed-use property
  • Who can be pursued? Former tenants, guarantors, sub-tenants
  • Forfeiture of leases - Formalities, peaceable re-entry, waiver and relief from forfeiture
  • Disrepair - Damages, forfeiture, Leasehold Property (Repairs) Act, Jervis v Harris claims
  • Unlawful assignments and sub-lettings - Crestfort v Tesco injunctions
  • Failure to leave at end of term - Double rent and mesne profits
