Introduction

Surveillance has long been an accepted feature of personal injury litigation to root out and discredit those claimants who mislead about the extent of their symptoms.

Whilst insurers apply often significant resources to combat fraud in all types of claim, it is personal injury claims where the largest sums are usually at stake.

Equally however for the claimant, they are against an insurer with deep pockets and resources. Some claimants have now resorted to covertly recording medical examinations with the defendants’ experts to demonstrate the extent of the examination that took place.

This course will explore current law and practice and importantly, the implications for both claimant and defendant.
