Following the recent judgments in WM Morrison Supermarkets plc v Various Claimants and Barclays Bank plc v Various Claimants this live broadcast session explores the recent cases and shines a light on vicarious liability.

The Judgment in Morrisons stated that the lower courts, 'misunderstood the principles governing vicarious liability in a number of relevant respects'.

The aim of this live broadcast session is to ensure that you are up to date with the current state of the law on vicarious liability.

What You Will Learn

This live and interactive broadcast will cover the following:

  • The principles which underpin vicarious liability
  • The courts’ approach to the relationship test and the sufficiently close connection test (the nature of the work undertaken and the need for a link to the wrongdoing complained of)
  • The quasi-employment test and when a non-employer may be held to be vicariously liable (akin to employment test as per Various Claimants v Catholic Welfare Society)
  • Practice points
  • Pitfalls and red flags for practitioners to avoid in risk assessing and pursuing cases involving vicarious liability
