For trade mark solicitors and attorneys advising owners of well-known or established brands, reputation-based grounds can provide an important additional route for challenging competing marks and protecting valuable brand assets. Unlike traditional likelihood of confusion claims, these provisions can apply even where the relevant marks or goods and services are not sufficiently similar to create a likelihood of confusion.
Reputation-based claims can, however, be evidence-intensive and require practitioners to establish the relevant reputation and demonstrate the necessary link, unfair advantage or detriment. Weak evidence or an insufficiently developed argument can undermine an otherwise promising claim.
