Presented by James Darbyshire of the FSCS, this webinar will provide a brief summary of pensions and the background to SIPPs as well as the current situation and recent trends including regulatory and legislative responses to SIPP mis-selling issues that practitioners need to be aware of.

    • Increasing popularity of SIPPs
    • Decreasing popularity of annuities as a way of providing post-retirement income
    • Trends towards greater pension freedoms and new decumulation/hybrid products

  • IFA SIPP Mis-Selling:
    • Summary of mis-selling claims
      • Mis-selling re: SIPP structure (e.g, unsuitable transfers from DB schemes to SIPPs)
      • Mis-selling re: underlying investments - i.e. unsuitable, particularly unregulated investments
    • Examples:
      • British Steel and IFAs
      • Upper Tribunal decision re: Tailormade Independent Limited
    • Defences:
      • Exoneration/exclusion clauses, COBS r.2.1.2, arguments based on causation and estoppel

    • SIPP operators / trustees (professional trustee duties, liability for ‘mis-investment’)
