Introduction

This full day masterclass is for private and elderly client law practitioners, including those who act as Professional Deputies or Attorneys, who have a working knowledge of the rules about paying for care and who want to understand how to secure funding assistance from health and social services while legitimately protecting a client’s assets.

Practitioners are increasingly familiar with older clients' concerns - or those of the family - that there will be nothing left for the family to inherit once long term care needs have been paid for. With two Government manifesto U-turns about adult social care since April 2015, it seems unlikely that the paying for care rules will become any fairer.

The latest long promised Green Paper has not yet materialised and the Association of Social Services Directors warns that adult social care is on the brink of collapse.

This masterclass is practical and tactical. With a workshop approach, practitioners are encouraged to bring their own live casework issues so that everyone can share tips and tactics. The detailed case studies provided with the course notes enhance the practitioner’s knowledge and experience, generate lively debate and leave the practitioner ready to apply the knowledge for their clients’ benefit. This course may also appeal to IFAs who deal with or are looking to deal with later life/SoLLA.

What You Will Learn

This masterclass will cover all the tools you need to assist and represent your client in common care funding matters including:

  • What happens when your client’s money runs out and how to ensure that the relevant statutory support and benefits are put in place
  • The distinction between a health need and a social care need when challenging decisions on funding made by Health and Social Services
  • Where misleading information has been given by Health or Social Services, for example, that the person is said to be ineligible for support because their needs are well-managed or because statutory services do not cover 24/7 care needs
  • Top-up issues for care homes and care at home and arbitrary caps / ceilings on funding for care packages
  • Disputes involving Needs v Preferences, discretionary decisions and top-tips for the most effective challenge letter
  • Proper Health and Social Services assessment processes for a safe hospital discharge
  • Disputes involving property disregards and joint beneficial ownership
  • Clients with PI settlements and CCG or Local Authority disputes as to their duty to fund care costs on the grounds of double recovery
  • Deprivation of capital or income allegations against your client or their family, including allegations of financial abuse, safeguarding and OPG investigations; and recovery action taken by Social Services
  • Challenging NHS CHC eligibility decisions and clarification on the updates made to the National Framework 2018
  • Section 117 Mental Health Act 1983 after care funding
  • Practical Case Studies: a range of case studies that demonstrate:
    • How to avoid or decrease a top-up payment, including calculations
    • How to get funding support for care at home, and avoid a care home admission
    • How to show that a gift was not a deliberate deprivation
    • Arguing for a nil valuation in a jointly beneficially owned property
    • Defeating allegations that planning ahead amounts to financial abuse
    • Attorney duties in a paying for care context
