Introduction

CPR 8 establishes an alternative procedure for bringing claims, intended to be used where a claim is unlikely to involve a substantial dispute of fact. It is also a required procedure where that is specified by another rule or practice direction.

The appropriate use of Part 8 will be considered in this virtual classroom seminar, particularly focusing on the main procedural differences between the ordinary progression of a claim under Part 7 and the process for taking a Part 8 claim forward, and looking at the applicable claim and acknowledgment forms as well the treatment of evidence.

In this live session we ask whether Part 8 offers a claimant civil justice without unnecessary ‘frills’ or is procedurally slanted against a defendant.

What You Will Learn

This live and interactive course will cover the following:

  • Is Part 8 a quicker process than Part 7?
  • What happens after service of Part 8 claim?
  • Can a Part 8 claimant get a default judgment?
  • What is a ‘substantial dispute of fact’?
  • At which point can a defendant object to the use of Part 8?
  • How is evidence dealt with in Part 8 claims?
  • Typical types of Part 8 claims including the mandated use of Part 8 under Practice Direction 49E
  • Stakeholder claims - CPR 86
  • Recent cases involving the use of Part 8
