Introduction

The Mental Health Tribunal makes crucial decisions about the lives of people detained in hospital under the Mental Health Act 1983, as amended in 2007, including some who have been given hospital orders by a criminal court. Since changes introduced by the Mental Capacity Act 2005, and Cheshire West [2014] on deprivation of liberty, the issues have become more complex. To demonstrate 'continued competence' representatives must be up-to-date with changes in law and practice.

This course will focus on areas key to the Law Society Mental Health Accreditation Scheme, such as the duty of confidentiality and is aimed at busy lawyers in need of an update on case-law relevant to those detained, relatives, local authorities and NHS Trusts.

This course is constantly updated and there will be scope for questions, discussion and sharing ideas.
