Introduction

Litigation is sometimes fast paced, often challenging and rarely predictable. Perhaps nothing embodies this better than when seeking an urgent remedy to protect your client's position.

Whether it is offensive online reviews, a director setting up a rival business, or a competitor selling ‘look-alike’ products, clients face daily threats to their livelihood. These often come without warning and at the most inconvenient of times. Clients and those advising them must move quickly in response.

The immediate answer is often to apply to court for an interdict to stop the particular act in question. Whilst such a robust and immediate solution often has the desired effect on its intended target, it is not without risk.

Before proceeding with such a course of action, lawyers (and of course their clients) need to fully weigh up the risks of doing so. What might seem like a quick and decisive step can often have longer term consequences for your client as they may ultimately be liable for damages for wrongful interdict or become embroiled in lengthy court proceedings.
