Introduction

Identification evidence can often be a vexed and complex issue. Various challenges arise at different stages of the proceedings.

This live broadcast session deals with the two leading authorities in relation to identification evidence along with the requirements of the Police and Criminal Evidence Act 1984, in particular Code D, before then moving on to look at the caselaw and guidance with regards to identification via social media.

Following this live session, you will have a sound knowledge of how to construct a case based on evidence of visual identification, will understand how this evidence may be challenged along the way, and will be able to deal with defects which may or may not be ultimately fatal to the case.

This live and interactive broadcast will cover the following:

  • Was a first description taken - does it matter?
  • Whether to hold an identification procedure or not?
  • If an identification procedure is not held, is that fatal to the case?
  • Errors in identification generally - can they be remedied with a direction to the jury?
  • Identification by social media - what is the evidential value and is it admissible?
