Financial Remedy with Modest Assets - Caselaw & Practice Points Explored
Introduction
Modest Asset cases are counter intuitively some of the hardest cases to resolve and advise upon. Often sharing does not meet need and there may be precious few other assets to call upon. Balancing need can be difficult, especially if one party has a significant need.
This webinar will consider the basic principles of asset division but then look at various of the specific issues which dog these tricky cases. It will also look at how the courts treat debts that can threaten to overwhelm parties and drain away the assets.
What You Will Learn
This webinar will cover the following:
- A brief recap of the basic principles of asset and debt division
- Various examples of how the courts have balanced and met competing needs in these cases and how they have resolved apparently insoluble cases
- A discussion of practice points, how to manage debts, how to secure evidence of value without an expert report and how to manage costs
- New and changing supports to help meet needs; schemes to assist with house purchase and how to manage borrowing
- Consideration of the practical and the legal and how they intersect
This pre-recorded webinar will be available to view from Tuesday 30th June 2026
