Introduction

When executors and trustees are appointed in wills, they often take on this role without understanding the full implications of the position.

When advising on an estate it is important to be aware of the full extent of the role so that you can explain this fully to your client.

Failure to manage the role correctly could result in the executor or trustee being personally liable. In addition, if your firm is appointed as executors you should ensure that the obligations are met to avoid any personal liability on the directors or partners.
