Delayed Cancer Diagnosis - Legal Strategies for Clinical Negligence Claims
Speaker
Introduction
Cancer encompasses a wide range of conditions, often presenting with varied and complex symptoms.
Designed for legal professionals involved in bringing or defending clinical negligence claims arising from delayed diagnosis of cancer, this webinar will examine potential breaches of duty, most commonly involving a failure to refer for further investigation at an earlier stage. This may arise in general practice, in the Emergency Department, or occasionally in other clinical settings. Cases involving inaccurate reassurance following misinterpreted scans will also be considered.
The webinar will also address the key issues of causation, including how claimants establish that a delay in diagnosis has resulted in additional injury, such as reduced life expectancy or the need for more invasive treatment that could have been avoided with earlier diagnosis.
What You Will Learn
This webinar will cover the following:
- Understanding the basis for the claim with reference to claimant evidence and medical records
- Identifying the relevant expert(s) to deal with the breach of duty issues
- Discussion of causation with experts in the fields of oncology, radiotherapy, and/or surgery
- Determination of the basis of loss arising from that causation
- Presenting the claim and calculating future losses with the use of appropriate quantum experts
- Dealing with the special problems of fatal claims if the claimant has died (or is likely to die) prematurely as a result of clinical negligence
This pre-recorded webinar will be available to view from Monday 5th October 2026
