Introduction

Major motoring offences are very serious and can have enormous consequences for everyone. They can result in a criminal record, a disqualification from driving and even a prison sentence for the more severe cases.

Aimed at both the prosecution and the defence this 2-hour virtual classroom seminar will provide an update on the more serious offences such as causing death by dangerous driving and causing serious injury by dangerous driving.

It will cover the relevant case-law in the following 12 areas and much more besides.

What You Will Learn

This live broadcast session will cover the following:

  • Causing death by dangerous driving - the legal definition of dangerous as opposed to merely careless or inconsiderate and the guidelines from the Sentencing Council
  • Mandatory period of disqualification - the disqualification period and the extension period when custody imposed - also extended re-tests - R v Mohammed [2020]
  • Causing death by dangerous driving - the interpretation from case-law of the word ‘causing’
  • Causing serious injury by dangerous driving - the meaning of serious injury - credit for an early indication of guilt - R v Handley [2020] - Sentencing Guidelines
  • Causing death by careless driving - pleading guilty at the first available opportunity - suspending the sentence - no requirement for extended re-test - R v May [2020]
  • Causing death by driving (unlicensed) (uninsured) (disqualified) - increase in penalty re causing death (disqualified) - Criminal Justice and Courts Act 2015 - indictable-only and carrying 10 years
  • Causing serious injury by driving (disqualified) - either-way and carrying 4 years on the indictment
  • The ‘causal connection’ between the death and the driving - the hugely important decision of the Supreme Court - R v Hughes (Appellant) [2013]
  • Aggravated vehicle taking (dangerous driving) (accident causing injury) (damage to the vehicle) (damage to something other than the vehicle) - disqualifications and re-tests
  • Aggravated vehicle taking (causing death) - the ‘causal connection’ between the death and the driving - the hugely important decision of the Supreme Court in Taylor overturning the earlier Court of Appeal decision of Marsh
  • Causing death by careless driving and the comments of the Court of Appeal concerning mobile phones - R v Liaqat [2019]
  • Causing death by careless driving when under the influence of drink or drugs - specimens taken from persons who are unconscious - ramifications of the refusal to allow the specimen to be analysed
  • Causing serious injury by dangerous driving - factors to take into consideration when assessing the length of the driving disqualification - R v Desouza [2020]
  • Extensions and adjustments when imposing both custody and a disqualification from driving - the leading case of R v Needham
