Introduction

Thirteen years have passed since the coming into force of the Family Law (Scotland) Act 2006 and with it the introduction of a statutory framework dealing with financial provision for cohabitants.

Despite the passage of time, the interpretation of the legislative provisions and the quantification of claims remains complex. Given the timescales and costs involved in pursuing claims under the framework, this is an area which can present concerns for family law practitioners.

This course will provide enhanced knowledge of the framework and a provide practical guidance to family lawyers for the handling of such cases.

What You Will Learn

This course will cover the following:

  • The statutory framework
  • Claims under s 28 (claims on separation) and a review of relevant case law
  • Claims under s 29 (claims on intestacy) and a review of relevant case law
  • Practical considerations for practitioners when drafting cohabitation agreements
