Introduction

A leaking roof, an unpaid contribution or a disputed managing agent can bring the management of a residential building to a standstill.

Where the same people are leaseholders, freeholders, company members and directors, identifying who has the power and obligation to act is often the first challenge.

This virtual classroom seminar will examine how to untangle those roles, resolve failures in decision-making and choose a remedy that gets the building functioning again.

What You Will Learn

This live and interactive course will cover the following:

  • Distinguish personal co-ownership, freehold companies and resident management companies, and identify the significance of each structure
  • Read the leases, titles, articles and ownership agreements together to establish responsibility and decision-making powers
  • Analyse voting rights, quorum requirements, conflicts of interest and director or member deadlock
  • Address disagreements over repairs, improvements, access and the appointment or replacement of managing agents
  • Distinguish service charge liabilities from separate company funding or contribution obligations
  • Identify who can enforce a covenant, against whom and through which forum
  • Assess court, tribunal and company law remedies against the practical outcome the client needs
  • Structure mediated settlements and management arrangements that reduce the risk of recurring disputes

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
