Introduction

Experience of personal injury practice can serve as a solid basis for fee earners wanting to transfer their skills into the field of clinical negligence. However, whilst the basic elements might look familiar, it will quickly become apparent that medico-legal cases are characterised by their own separate and distinct legal issues, rules, evidence, heads of loss, and procedures. Failing to recognise these differences can leave uninitiated practitioners vulnerable to common pitfalls and limit the chances of successfully managing a clinical negligence caseload.

This virtual classroom seminar aims to explore the areas of overlap between personal injury and clinical negligence law, whilst leading practitioners through core medico-legal concepts. The focus of the live session will be on using practical examples of clinical negligence cases as a springboard to identify key legal issues, understand the practical stages of an effective medico-legal investigation, recognise the differences between common types of defendants and also support vulnerable clients through the rigors of a legal claim which could run for several years.
