This 2 day course will provide a complete procedural guide to civil litigation and the court process.

It is suitable for trainees, newly qualified solicitors, paralegals and those returning to work after a career break and will bring together procedural knowledge as well as the skills of negotiation, drafting and advocacy to increase your confidence in embarking or resuming litigation practice.

The Course Objectives:

  • To follow a claim through from beginning to end
  • To understand key parts of the Civil Procedure Rules and how they have been reformed
  • To adopt best practice in preparing a claim and a defence
  • To understand the role of the client, witnesses, experts, counsel and the court
  • To engage in litigation tactics to the advantage of your client
  • To bring a case onto trial
  • To understand how to resolve and settle a claim

Day One:

  • What is now required in the Pre-Action Process
  • Issue of the forms and service - drafting simply
  • Different 'tracks' have different rules
  • Part 36 and offers to settle 'without prejudice' - how to negotiate a deal
  • Preparing for the Case Management Conference and costs budgeting
  • Directions and timetabling
  • Evidence gathering (people and documents) and project management skills
  • Practical exercise and roles for the trial

Day Two:

  • Using the rules to your advantage - making an application and responding to one
  • The different applications explained - DIY advocacy
  • Disclosure of documents
  • Exchange of witness statements
  • Experts' reports
  • The run up to trial (Listing) and the Pre-Trial Review
  • Managing the trial itself - practical exercise
  • Costs and enforcement
