Introduction

Care home contracts can raise a number of important legal and practical questions for attorneys, deputies and those advising individuals who are entering residential care. Getting the contracting parties and their respective responsibilities right is essential, particularly where an attorney or deputy is acting on behalf of a resident.

This practical new virtual classroom seminar will examine who should enter into the contract and in what capacity, including when it may be appropriate for the contract to be with someone other than the resident. It will consider what should and should not be included in a care home contract, how to identify potentially unfair terms and the key clauses that attorneys and deputies should scrutinise.

The session will provide practical guidance on the contractual issues that can arise when arranging care and highlight particular provisions that require careful consideration, including what happens when the resident dies.
