Introduction

This webinar will consider the recoverability of damages for child claimants in the ‘lost years’, following the Supreme Court’s recent seminal decision in CCC v Sheffield Teaching Hospitals NHS Foundation Trust.

Since the Court of Appeal’s judgment in Croke v Wiseman, child claimants have been unable to bring claims for damages arising in the ‘lost years’: where a child claimant’s life expectancy has been reduced by reason of the defendant’s negligence, no damages for loss of income could be recovered in the period between the end of the claimant’s now shortened life expectancy and his/her previously uninjured, longer, anticipated life-expectancy.

Whether the approach in Croke is sustainable as a matter of principle, should continue to be followed and applied and whether a child claimant can recover damages in the ‘lost years' has now been authoritatively determined by the Supreme Court in CCC v Sheffield.
