Boundary Disputes - Drawing the Line
Boundary disputes are notorious for being conducted with rancour, and often as a result at a cost which is completely disproportionate to what is at issue.
However, two recent initiatives aim to improve matters.
The Property Boundaries (Resolution of Disputes) Bill proposes a compulsory expert determination procedure, while a recently published Boundary Disputes Protocol aims to encourage best practice in the conduct of disputes and voluntary reference to existing alternative dispute resolution mechanisms.
The arcane rules governing the ascertainment of boundaries, and the difficulties of transposing a line on a plan to a line on the ground, can be compounded when a claim to adverse possession in thrown into the mix.
