Introduction
This new virtual classroom seminar will provide a structured introduction to the legal framework governing custodial decision-making and release processes in England and Wales.
It identifies the key sources of law and policy encountered in day-to-day practice and offers a practical approach to challenging or defending decisions affecting progression, parole and recall. The session focuses on the procedural and evidential issues that most commonly arise.
You will leave with a clear framework for identifying the appropriate route of challenge or response, understanding likely remedies and avoiding common errors that can lead to unlawful decision-making, delay, or unnecessary litigation and costly mistakes.
What You Will Learn
This live and interactive course will cover the following:
- Sentencing, release, parole and recall (the legal structure of detention and progression)
- Prison Rules / HMPPS policy (the operational framework for custodial decision-making)
- Public law / judicial review (lawfulness of decisions and procedural fairness)
- Human rights and equality law (standards governing treatment, conditions and decision-making)
- Complaints and oversight mechanisms (internal complaints; PPO; IMB; inspection frameworks)
- Remedies and redress (public law remedies such as quashing orders and declarations; and, where a separate cause of action is established, potential damages under the Human Rights Act, Equality Act, or relevant torts)
