The law on charging for care in Wales is governed by the Social Services and Wellbeing (Wales) Act 2014 and the regulations that surround it.

This new course will help you to understand the way the law works in practice, including knowing the capital limits, care in the home, the nursing contribution, basic rules surrounding entitlement to benefits that assist with care costs and the fundamentals on who may be entitled to nursing care funded by the NHS.

You will also find out what should be taken into consideration when dealing with capacity and best interests tests.

The course will also cover the basics when advising about preservation of assets from the impact of care home fees, the options that you may wish to use, whether they work in practice and issues you need to take into account when advising your clients.

What You Will Learn

This course will cover the following:

  • The governing law relating to care in Wales
    • The legal basis for charging for care in Wales whether at home, in a care home or in a hospital
    • Who pays and when? Is the Local Authority (LA) or the NHS able to help?
    • When and how can the LA challenge the financial information your clients have given them?
    • Relevant legislation and codes of practice including Social Services Wellbeing (Wales) Act 2014, Mental Capacity Act 2007, s.117 Mental Health Act 1983
  • The appropriate steps to take when advising clients about preservation of assets
    • Factors to be taken into account when advising clients who wish to plan for their future and what is right for them
    • Asset protection trusts - what you need to know
    • Wills - a safe alternative?
    • Equity release - the role of a private client lawyer
