Introduction
This Learn Live session will explore whether regulatory enforcement on AI will echo the approach taken regarding GDPR failures. The GDPR torpedoed the risk profile of handling personal data to Board level by materially increasing the expectations on organisations handling personal data and the enforcement powers of regulators if they got it wrong.
Eight years on from GDPR, organisations are generally accustomed to implementing GDPR into their compliance framework and gaining an understanding of how certain breaches may be viewed by regulators. However, without specific AI regulation currently in force in the UK, how will the UK Information Commissioner approach enforcement action that concerns AI under the current principle based and data focused regime?
Given the potentially significant impact AI and Automated Decision Making can have on individuals, will cases involving AI be treated more seriously? Or will a more lenient approach be adopted, at least initially, while the law and regulator catch up?
Attendees will gain clarity on the current position of regulatory enforcement on AI compared with the approach for GDPR failures generally. The session will focus mainly on the UK with a comparative look at the EU approach being considered. Attendees will learn of regulatory expectations and any indicators of future reform with regard to AI regulation and enforcement which will be useful in considering liability and compliance strategies.
